These Terms of Service (“Terms”) govern your access to and use of the VPS hosting services provided by SilvaHost (“we”, “our”, “us”) via silvahost.net. By purchasing or using our Services, you (“Customer”) agree to these Terms in full. If you do not agree, do not use our Services.

1. Services

SilvaHost provides KVM VPS hosting services with dedicated resources as described in the selected plan. Available plans range from KVM VPS 1 to KVM VPS 6, with Linux and Windows operating system options. Specifications, pricing, and features are listed on our pricing page and may be updated with reasonable notice.

2. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use our Services.
  • Business accounts must be registered to a valid legal entity.

3. Acceptable Use Policy

You agree not to use our Services to:

  • Send unsolicited bulk email (spam) or conduct email harvesting.
  • Host or distribute malware, ransomware, spyware, phishing pages, or illegal content.
  • Conduct or facilitate DDoS attacks, port scanning, or any unauthorised network intrusion.
  • Mine cryptocurrency in a manner that degrades shared network or infrastructure performance.
  • Host, distribute, or transmit content that is illegal under EU or applicable national law.
  • Resell or sub-lease server resources without express written permission from SilvaHost.

Violation of this policy may result in immediate suspension or termination of your service without refund. SilvaHost reserves the right to determine what constitutes a violation.

4. Payment Terms

  • Services are billed monthly in advance.
  • Payments are processed via Shopify Payments or PayPal. By completing a purchase you agree to the terms of the respective payment processor.
  • All prices are in Euros (EUR). EU customers may be subject to VAT in accordance with applicable regulations.
  • Invoices are issued electronically to the email address on your account.
  • Non-payment may result in service suspension after 7 days and permanent termination after 14 days, with data deletion.
  • Chargebacks or payment disputes result in immediate account suspension pending resolution.

5. Refund and Money-Back Policy

  • New customers are eligible for a 15-day money-back guarantee on their first order only.
  • Refund requests must be submitted within 15 calendar days of the initial purchase date by emailing support@silvahost.net.
  • Refunds are processed back to the original payment method within 5–10 business days.
  • The money-back guarantee does not apply to: subsequent renewals, plan upgrades, accounts terminated for Acceptable Use Policy violations, or accounts with excessive resource abuse.
  • Windows Server license fees (€5/mo add-on) are non-refundable once the OS has been provisioned.
  • Partial-month refunds are not available outside the 15-day window.

6. Service Level Agreement (SLA)

  • SilvaHost guarantees 99.9% monthly network uptime for all VPS plans.
  • Scheduled maintenance windows are announced at least 24 hours in advance and are excluded from uptime calculations.
  • In the event of verified downtime exceeding the SLA threshold, customers may request a service credit equal to the pro-rated value of the affected period, up to a maximum of one month's service fee for the affected VPS.
  • SLA credits must be requested within 7 days of the incident and are applied as account credit, not cash refunds.

7. Data and Backups

  • SilvaHost provides weekly automated snapshots as a convenience feature on all plans. These are best-effort and are not guaranteed.
  • Weekly snapshots are a supplementary feature, not a backup service. You are solely responsible for maintaining adequate and independent backups of all data on your VPS.
  • SilvaHost shall not be liable for any data loss, regardless of cause.

8. Intellectual Property

SilvaHost retains all intellectual property rights to its software, infrastructure, brand assets, and trademarks. You retain full ownership of content and software you host on your VPS. You grant SilvaHost no rights to your hosted content except as required to provide the Services.

9. Cancellation and Termination

  • You may cancel your subscription at any time by emailing support@silvahost.net before your next billing date.
  • Monthly plans are cancelled at the end of the current billing period. No partial-month refunds are issued outside the 15-day money-back window.
  • Annual plans are not refunded for unused months after the 15-day money-back window has passed.
  • SilvaHost may suspend or terminate your Service immediately for: AUP violations, non-payment, fraudulent activity, or legal requirements.
  • Upon termination, your VPS and all associated data are permanently deleted within 7 days. Ensure you have exported any necessary data before cancelling.
  • SilvaHost reserves the right to modify or discontinue any Service with 30 days written notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, SilvaHost’s total cumulative liability to you for any claim arising from or related to these Terms or the Services shall not exceed the total fees paid by you in the 3 months preceding the claim. SilvaHost is not liable for:

  • Indirect, incidental, special, punitive, or consequential damages.
  • Loss of data, revenue, profits, or business opportunities.
  • Service interruptions caused by force majeure events (natural disasters, government actions, third-party outages).

11. Indemnification

You agree to indemnify, defend, and hold harmless SilvaHost, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or rights of a third party.

12. Governing Law and Disputes

These Terms are governed by applicable international commercial law. Our server infrastructure is operated from EU datacenters located in Frankfurt, Amsterdam, Paris, and London. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation within 30 days. If unresolved, disputes shall be subject to binding arbitration under internationally recognized arbitration rules.

Nothing in these Terms limits your rights as a consumer under applicable law in your country of residence.

13. Shopify and PayPal Terms

Purchases made through silvahost.net are processed via the Shopify platform and optionally via PayPal. By completing a purchase you also agree to:

SilvaHost is an independent merchant; Shopify and PayPal are payment infrastructure providers and are not parties to any hosting agreement between you and SilvaHost.

14. Changes to These Terms

SilvaHost may update these Terms at any time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
